Terms of Service

These Terms of Service ("Terms") are an agreement between you and Hydra Media LLC d/b/a Pingwren ("Pingwren", "we", "us") for use of https://pingwren.com and the Pingwren website monitoring service (the "Service").

1. The Service

Pingwren checks the availability of websites you add, records the results, and sends alerts by email and, if you opt in, by text message. Monitoring is performed from outside your network and cannot guarantee detection of every outage.

2. Accounts

You must provide accurate information, keep your password secure, and be at least 18 years old. You are responsible for activity under your account.

3. Acceptable use

You may only monitor websites that you own or are authorized to monitor. You may not use the Service to overload, attack or test the security of third-party systems, or to violate any law.

4. Plans and billing

The Free plan is provided at no charge. Paid plans are billed monthly in advance and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice by email.

5. Text messages

Text message alerts are optional and governed by our SMS Terms. Accepting these Terms does not enroll you in text messages. Reply STOP to any message to opt out, or HELP for help. Message and data rates may apply.

6. Your data

You keep ownership of the data you provide. You grant us the rights needed to operate the Service. Our use of personal information is described in the Privacy Policy.

7. Availability and disclaimer

The Service is provided "as is" and "as available". We do not warrant that alerts will always be delivered or delivered on time, including because of email or mobile carrier delays.

8. Limitation of liability

To the maximum extent permitted by law, Hydra Media LLC is not liable for indirect, incidental or consequential damages, or for lost revenue resulting from website downtime, and our total liability is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You may delete your account at any time. We may suspend accounts that violate these Terms.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.

11. Changes

We may update these Terms and will post changes on this page with a new effective date. Material changes will be emailed to account owners.
